  1. The Bandit 2001 - SHAREWARE VERSION

  3. LICENSE FOR "Bandit-sw.prc" which will, from here on in, be 
  4. referred to as "THE SOFTWARE".
  5.  
  6. The REGISTERED VERSION is that version in which the game Feature 
  7. Board, as described in the Bandit 2001 user manual, is available.
  8. The SHAREWARE VERSION displays a message to the user indicating that
  9. they must register in order to play the Feature Board.
  10.  
  11. The REGISTERED VERSION is only available for purchase.
  12. The SHAREWARE VERSION is freely available on the internet.
  13.  
  14. This license is for the SHAREWARE VERSION.
  15.  
  16. The Bandit 2001 is Copyright of Gary Steven Rigg whom will, from
  17. here on in, be referred to as "THE AUTHOR"

  19. THE AUTHOR licenses THE SOFTWARE to you only upon condition
  20. that you accept all of the terms and conditions contained in this
  21. license agreement. These terms and conditions are accepted by 
  22. installing THE SOFTWARE on a compatible device. If you do not
  23. agree to these terms and conditions then you must not use THE 
  24. SOFTWARE and should delete all copies from your system. No 
  25. adjustment or alteration to these terms & conditions will be 
  26. accepted.

  28. Whilst THE AUTHOR endeavours to produce high quality, reliable 
  29. software you accept that no software can be free of error, 
  30. and use of THE SOFTWARE is entirely at your own risk. THE AUTHOR
  31. cannot be held responsible for any loss or corruption of data or 
  32. software, lost profits or other incidental, indirect or 
  33. consequential damages arising from the use or misuse 
  34. of THE SOFTWARE.

  37. attached documentation and all associated works of art, music, 
  38. text, animation, photographs and sound effects.

  43. SOFTWARE LICENSE AGREEMENT

  45. 1) GRANT OF LICENSE 
  46. THE AUTHOR grants you a nonexclusive and limited license to
  47. use THE SOFTWARE, in object code form only, including associated 
  48. documentation provided by in connection therewith solely in 
  49. accordance with the terms and conditions of this License
  50. Agreement. THE SOFTWARE is licensed, not sold, to you. You may
  51. install and use THE SOFTWARE on any number of handhelds in the
  52. United States, Unites Kingdom and any other country to which 
  53. THE SOFTWARE is legally exported. THE SOFTWARE is "in use" on a 
  54. handheld when it is resident in memory or other storage medium 
  55. accessible from the handheld.

  57. 2) DISTRIBUTION
  58. You may freely distribute THE SOFTWARE to third parties in its 
  59. original form. No right to distribute derivative works of THE 
  60. SOFTWARE is granted. Licensing or renting THE SOFTWARE or any 
  61. derivative work to third parties for a fee (whether direct or
  62. indirect) is strictly prohibited. Each time you distribute THE 
  63. SOFTWARE the recipient automatically receives this license to use,
  64. copy, and distribute THE SOFTWARE subject to these terms and 
  65. conditions.

  67. 3) MODIFICATION
  68. Except as expressly permitted by this License Agreement, you 
  69. hereby acknowledge and agree that you will not modify, reverse 
  70. engineer, disassemble or decompile THE SOFTWARE or any portion 
  71. thereof or translate THE SOFTWARE object code in any way. 
  72. You will not attempt to circumvent any limitations or copy 
  73. protection in THE SOFTWARE.

  75. 4) TECHNICAL SUPPORT 
  76. The provision of technical support for THE SOFTWARE is entirely 
  77. at the discretion of THE AUTHOR. If available, such support 
  78. will be provided only via e-mail unless otherwise determined by

  81. 5) COPYRIGHT
  82. THE SOFTWARE is copyrighted by THE AUTHOR.  You may not copy THE
  83. SOFTWARE except: (a) to provide a single backup copy on a desktop 
  84. computer; (b) as necessary for the execution of THE SOFTWARE. You 
  85. must reproduce and include all copyright notices, trademarks or 
  86. other proprietary legends of THE AUTHOR in any copy of THE 
  87. SOFTWARE made by you. Any and all other copies of THE SOFTWARE 
  88. and/or the documentation made by you are in violation of this 
  89. License Agreement.

  91. 6) OWNERSHIP
  92. You agree that THE AUTHOR retains all right, title and 
  93. interest in and to THE SOFTWARE and all copies at all times, 
  94. regardless of the form or media in or on which the original or 
  95. other copies may subsequently exist. You agree that you neither 
  96. own nor hereby acquire any claim or right of ownership to THE 
  97. SOFTWARE or to any related patents, copyrights, trademarks or 
  98. other intellectual property. You agree to use your best efforts 
  99. to prevent and protect the contents of THE SOFTWARE from 
  100. unauthorised disclosure or use.  THE AUTHOR reserves all 
  101. rights not expressly granted to you by this license.

  103. 7) TERM AND TERMINATION 
  104. This License Agreement is effective until terminated. THE AUTHOR
  105. may terminate this License Agreement  if you fail to comply
  106. with the terms and conditions. In such event, you must destroy all
  107. copies of THE SOFTWARE. You may terminate this License Agreement
  108. at any time by providing THE AUTHOR with written notice, 
  109. provided that you have complied with the destruction policy 
  110. outlined below. This License Agreement will automatically 
  111. terminate if you fail to comply with its terms and conditions. You
  112. agree that, upon any termination, you will destroy all copies of 
  113. THE SOFTWARE and certify to THE AUTHOR, in writing, that all
  114. copies and partial copies thereof have been completely destroyed 
  115. and are no longer being used.

  117. DISCLAIMER OF WARRANTY

  119. BECAUSE THE SOFTWARE IS PROVIDED FREE OF CHARGE, THERE IS NO 
  120. WARRANTY FOR THE SOFTWARE. TO THE MAXIMUM EXTENT PERMITTED BY 
  121. APPLICABLE LAW, THE SOFTWARE IS PROVIDED "AS IS" WITHOUT 
  122. WARRANTIES, CONDITIONS, REPRESENTATIONS OR GUARANTIES OF ANY KIND,
  123. EITHER EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, ANY 
  124. IMPLIED WARRANTIES OR CONDITIONS OR MERCHANTABILITY, SATISFACTORY
  125. OR MERCHANTABLE QUALITY, TITLE, NONINFRINGEMENT OR FITNESS FOR A 
  126. PARTICULAR PURPOSE. THE AUTHOR DOES NOT WARRANT THAT THE 
  127. OPERATION OF THE SOFTWARE WILL BE UNINTERRUPTED OR ERROR FREE. 
  128. THIS DISCLAIMER OF WARRANTY CONSTITUTES AN ESSENTIAL PART OF THIS
  129. LICENSE AGREEMENT. YOUR STATUTORY RIGHTS ARE UNAFFECTED.
